Defense verdict in insurance bad faith trial

A Cleveland County (Okla.) jury returned a defense verdict for Foremost Insurance Company and Farmers Insurance Exchange in a bad faith case on May 8, 2015.  CDR shareholder Michael Duncan and associate Anna Brannon represented the insurance companies in the trial, which spanned nearly three weeks.

The plaintiffs contended the insurers had breached their obligation of good faith and fair dealing in the handling of a homeowners insurance claim arising from the May 20, 2013 tornado in Moore, Oklahoma. Foremost had paid the plaintiffs to repair the home, but the homeowners chose not make repairs, resulting in the home being demolished as a nuisance by the City of Moore in December 2013.  The jury concluded the plaintiffs had not proven the insurers had acted unreasonably in the handling of the claim.
